All arrangements made between Star Air Executive Travel Limited, a fully bonded member of Abta (E9198) and Atol (5789), trading as Mauritius Mauritius, hereinafter called the "company", and you the client are subject to the following conditions. The person signing the booking form warrants that he has the authority of all other persons included in the holiday to make the booking on their behalf.
TIME OF BOOKING:
The Deposit is 10% of the total cost of the holiday; this must be submitted to the company (unless the booking is made less than 9 weeks prior to departure, in which case full payment is required). If booking with a low cost airline ie Go or Easy jet the cost of the ticket plus deposit must be taken at time of booking. The booking is binding upon the company only when it has issued to the client a written confirmation, unless you are making a booking which is departing within 7 days, a contract between us will exist when we, or your Travel Agent, on our behalf tell you that your booking is confirmed. Any money paid by a client to a travel agent in respect of a booking with the company and held by the agent is, at all times, and is held on behalf of the company.
The Company reserves the right to decline any booking at any time.
The Company is not under any obligation to deliver any tickets or documentation, appertaining to the booking, until The Company, or your Travel Agent has received full payment, if the booking has been made via a Travel Agent.
FINAL PAYMENT:
The total cost of any booking will be paid no less than 9 weeks prior to the departure date of the holiday, to the Company. In the event that payment is not received by the company by the date, the Company may choose to treat the booking as being cancelled by the client, in which case the deposit will be forfeited as per our cancellation fees listed hereunder. You, or any member of your party, have the right to cancel your holiday at any time, providing that the person who signed the booking form makes the cancellation, and the cancellation is communicated via writing, via the Travel Agent if the booking has been made through the Travel Agent. As this incurs administrative costs, we will retain your deposit and in addition will apply cancellation charges as a percentage of the entire holiday cost, as shown below.

However, if your booking includes a flight based on a restricted fare (e.g. Apex fare, World offer, Charter ticket) cancellation charges may be higher, up to in some cases the full amount of the booking.
Optional Insurance premiums are not refundable in the event of cancellations.
CHANGES TO YOUR HOLIDAY PLANS:
In the unlikely event that we need to make any changes to your holiday arrangements once they are confirmed, as we plan many months in advance, this sometimes may be necessary. Most of the time, these will be minor changes, but where they are major, for example, a significant change in resort, a change of accommodation to that of a lower category, a change of flight time more than twelve hours or a change of departure Airport, except between London Airports, we will inform you or your Travel Agent when you book, or as soon as possible if you have already booked. You then have the following choices:
A) To accept the alternative offered by the Company
B) To Choose another holiday featured by Mauritius Mauritius
C) To cancel and receive a full refund of all monies paid to us
Whichever of the above options you decide to take, we will pay you compensation (Not Including infants under the age of 2 on the date of travel)

These payments will not be made for changes beyond our control. For example, technical or maintenance problems with transport, changes imposed by rescheduling or cancellation of flights by an airline or main charterer, the alteration of the airline or aircraft, refusal of landing rights by the CAA to any airline. This also includes any other acts of force majeure (namely: war or threat of war, riots, terrorist activity, civil strife, strikes and other industrial disruption, natural disasters, fire, quarantine, epidemics, weather conditions, Government action, or other events beyond our control.
We reserve the right in any circumstances to cancel your holiday, and all holidays operate subject to a minimum number of participants. However, in no case will we cancel your holiday less than eight weeks before your scheduled departure date, except for reasons of force majeure as defined above. In circumstances that where we are unable to provide the holiday booked, we will return to you all monies paid or offer an alternative holiday (featured by Marbella Marbella or Mallorca Mallorca) of comparable standard and if cancellation occurs within eight weeks of departure, compensation on a similar scale to that shown above.
If we have to curtail your holiday due to a situation of force majeure, will offer a pro-rata refund for unused accommodation and excursions only. Compensation will not be payable.
AMENDMENTS BY THE PASSENGER:
The passenger who has signed the booking form once confirmed can make alterations to the booking, there will be administration charges of £50 per person or £75 per person for land only arrangements. Such transfer can be effected only with at least 8 weeks notice and provided that the requested facilities and seats are available at the time of request. If alterations occur within eight weeks, we may treat this as cancellation and charge as above. Changes are at the company's discretion, and can be refused.
LIABILITY OF THE OPERATOR:
The liability of the operator and other parties involved in supplying services in connection with the holiday may be limited by international conventions including the Athens convention relating to the carriage of Passengers and their luggage by Sea (1974), the Warsaw convention on International carriage by Air (1929), the Berne convention on carriage by rail (1980), and any applicable protocols or amendments. The Operator shall be entitled to the maximum protection allowed by law in respect of its liability of or any limitation on damages recoverable. The liability of the operator, for the loss of life or injury to a passenger, or for loss or damage of baggage during the holiday, wherever and whenever occurring, shall in no circumstances exceed the limits under the Athens Convention which are: For the loss of life or injury £41, 066, for cabin baggage about £733 and for other baggage or property about £1056, subject in the case of baggage to a deductible of about £11. The operator shall not be liable in respect of a claim, for detention, delay or over carriage however caused.
Any claim for loss of life or injury shall be notified to the Operator in writing within 6 months from the day when the loss of life or injury occurred. For the purpose of this contract, the word passenger includes the person who is signing the booking form and all persons including children detailed there in. English Law shall govern all contracts incorporating these terms.
No refund or compensation will be made or given for any unused hotel/apartment accommodation or any unused services or features of the tour or holiday, nor will such accommodation, services or features be exchangeable for any other accommodation, service or features.
TRAVEL INSURANCE:
You must have comprehensive Travel Insurance when travelling, if you are not taking our Insurance cover, than you must purchase your own, the cover should be at the same standard of cover or greater.
We as a company can refuse to accept you as a customer or continue dealing with you if your behaviour disrupts and affects any other holidaymakers, employees or any other third party. If we do this, we will not be responsible for any additional costs you have to pay. If you are prevented to from travelling because in the opinion of any person in authority you appear to be disruptive, we will have no further liability to complete your holiday arrangements, and will not be liable for any refund or compensation.
Whilst we endeavour to ensure that all of the details shown in this brochure are correct, changes may need to be made to the brochure descriptions, facilities offered etc. We do therefore reserve the right to make changes to the particulars contained in this brochure, you will be notified of such changes at the time of booking. |
